1. Eligibility

This Campaign is open only to individuals who submit an application through the official advertisement or designated web form and who are 18 years of age or older as of the date of application.

Applicants must be legal residents of the United States.

If you have received a complimentary session or promotional credit from Breshears Professional Photography within the past 365 days, you are not eligible for this opportunity.

Employees of Breshears Professional Photography, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, and their immediate family members or those living in the same household, are not eligible to participate.

This Campaign is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

2. Agreement to Rules

By applying, you (“Applicant”) agree to be fully and unconditionally bound by these Terms and Conditions and represent that you meet all eligibility requirements. You agree that the decisions of Breshears Professional Photography are final and binding in all matters related to this Campaign.

3. Campaign Period

Applications will be accepted online until the Campaign is closed by Breshears Professional Photography.

4. How to Apply

Applicants must complete and submit the official online form provided via the advertisement or designated web page. Applications must include all required information and meet stated eligibility requirements.

Incomplete or inaccurate applications may be disqualified at the sole discretion of Breshears Professional Photography. Applicants may only apply once per household. Multiple applications using different names, emails, or devices may result in disqualification.

5. Opportunity Details

Selected applicants will receive an invitation for a Portrait Session and a complimentary artwork credit toward custom wall art for their home.

The specific value of the artwork credit and session details are determined solely by Breshears Professional Photography. The opportunity is non-transferable and may not be exchanged for cash or substituted except at the discretion of Breshears Professional Photography.

Any federal, state, or local taxes or additional costs associated with acceptance are the sole responsibility of the recipient.

Acceptance of the opportunity constitutes permission for Breshears Professional Photography to use the recipient’s name, likeness, image, voice, and statements for marketing and promotional purposes without further compensation, unless prohibited by law.

6. Notification and Response

Selected applicants will be notified by text message, phone, or email within five (5) days of selection.

Breshears Professional Photography is not responsible for communications blocked by spam filters, incorrect contact information, or delivery issues.

If a selected applicant does not respond within 10 days or fails to schedule or attend their consultation or portrait session, the opportunity may be forfeited.

7. Rights Granted by You

By submitting an application, you grant Breshears Professional Photography and its agents, successors, and assigns a perpetual, worldwide, royalty-free right to use your name, image, likeness, voice, and statements for promotional, advertising, and marketing purposes in any format or medium, now known or later developed, without additional compensation or notice, unless prohibited by law.

8. Terms & Conditions

Breshears Professional Photography reserves the right, in its sole discretion, to modify, suspend, or terminate the Campaign for any reason, including fraud, technical issues, or circumstances beyond its control.

The company also reserves the right to disqualify any applicant who tampers with the application process, violates these Terms, or attempts to undermine the integrity of the Campaign.

Any deliberate attempt to interfere with this Campaign may violate civil or criminal laws. Breshears Professional Photography reserves the right to pursue all available remedies to the fullest extent permitted by law.

9. Limitation of Liability

By participating, you agree to release and hold harmless Breshears Professional Photography, its affiliates, employees, and partners from any claim, injury, loss, or damage arising from your participation in this Campaign or use of any offer provided.

10. Disputes

This Campaign is governed by the laws of the State of Washington, without regard to conflict of law principles.

Any disputes arising out of this Campaign shall be resolved exclusively in a court of competent jurisdiction located in Washington State.

Participants waive all rights to punitive or consequential damages and agree to resolve disputes individually, without resort to class action.

11. Privacy Policy

Information submitted with your application is subject to the Privacy Policy on the Breshears Professional Photography website.

Your contact information will be used solely for purposes of scheduling, communication, and marketing related to this Campaign unless you explicitly opt out or decline further contact.

This Campaign is not sponsored, endorsed, administered by, or associated with any social media platform, including Facebook, Instagram, TikTok, or YouTube.

By applying, you release all social media platforms from any liability associated with this Campaign.

14. Session Policies

Our artists reserve dedicated studio time to provide each client with a personalized, one-on-one experience during their portrait and ordering sessions.

To secure your appointment, a fully refundable deposit is required. This deposit is refunded after your View & Order appointment.

We require two weeks’ notice for any cancellation or reschedule. Failure to attend your session without notice will result in forfeiture of your deposit and artwork credit.
